Elliot Lake needs to appoint new mayor or hold by-election

On Friday, a three-judge panel ruled against all eight grounds for appeal filed by former mayor Chris Patrie and upheld a two-year disqualification from city council

On Friday December 15, 2023 the Ontario Divisional Court upheld the lower Court’s finding that Mayor Patrie had breached the Municipal Conflict of Interest Act and that his actions warranted his immediate removal from Council. The Court also upheld his disqualification from being a member of Council or of any local board for two years effective January 2023.

Mr. Patrie exercised his right to appeal, claiming that there were numerous errors in the original decision, but the Divisional Court rejected all of his grounds. The Divisional Court’s decision is posted on the city’s website

This case concerned a series of events in 2019 when Mr. Patrie was then a councillor. As a result of this decision, the City will recover more than $100,000 from Mr. Patrie to cover its costs in both legal proceedings.

Acting Mayor Wannan, Council and the City’s administration expect this decision to be the final determination. The City of Elliot Lake will continue its ordinary business with Acting Mayor Wannan as interim head of council. Council will need to make a decision within 60 days to appoint a person to the position of mayor or to hold a by-election to fill the vacancy.
